On October 13, 2026, the Technical Regulation on the Receipt, Registration, Routing, and Incorporation of Submissions, Supplementary Filings, and/or Supporting Documents into Administrative Case Files of the National Intellectual Rights Service (SENADI) was published in Official Gazette No. 388, pursuant to Resolution No. SENADI-DG-2026-0028-RE.
The regulation establishes the conditions governing the submission, receipt, and incorporation of documents into administrative proceedings conducted before SENADI.
- Submission of Documents and Acknowledgment of Receipt
Written submissions, supplementary filings, and supporting documents must be submitted through any of the official channels authorized for the corresponding procedure.
The receiving unit must issue an acknowledgment confirming receipt of the document. For physical submissions, the date and time of receipt must be recorded and preserved throughout the subsequent digitization and processing of the documents.
- Receipt, Registration, and Incorporation of Documents
Documents submitted through an official channel that is not authorized for the corresponding procedure will not be deemed duly filed and will have no legal effect within the proceedings. Any subsequent internal routing of such documents will not remedy this deficiency.
Exceptions apply where an alternative channel has been expressly authorized or where the use of a different channel results from an error attributable to SENADI.
Likewise, documents submitted through unofficial channels will have no procedural effect, without prejudice to the institution’s obligations in cases involving errors attributable to the Authority itself.
- Receipt of Documents During Technological Disruptions
In the event of technological failures preventing the electronic receipt of documents, physical submissions will be accepted through officially authorized in-person channels.
Exceptionally, where disruptions to the institution’s infrastructure make it impossible to use SENADI’s electronic channels, the highest-ranking authority or its delegate may authorize alternative submission channels, which must be duly identified and publicly announced.
Documents submitted through these channels will produce the corresponding legal effects as of the documented date and time of receipt.
- Institutional Responsibilities
Each SENADI unit will be responsible for managing documents and procedural actions within its respective area of competence. Furthermore, no submission channels capable of producing legal effects may be established without proper authorization and official public notification.
Where a document has been submitted within the applicable deadline through an officially authorized channel but has not been incorporated into the administrative case file for reasons attributable to SENADI, the Authority must locate and incorporate the document before issuing its decision, without prejudicing the rights of the party concerned.
Likewise, requests for clarification or correction will not suspend administrative time limits or deadlines, unless expressly provided by law.
- Implementation and Entry into Force
Within 30 days following publication of the resolution, the competent units must submit the information required for the approval of the institutional matrix of official submission channels.
Until this matrix has been approved and published, the channels formally authorized for each procedure will remain in effect. No changes may be enforced against users unless they have been officially announced in advance.
The resolution entered into force upon its signing on September 26, 2026.
