WORKPLACE HARASSMENT AND PSYCHOSOCIAL RISK PROTOCOL: AN OBLIGATION VERIFIED IN PRACTICE

Escrito por:

Every employer, regardless of the number of employees, is required to manage psychosocial risks in the workplace. In addition, Ministerial Agreement MDT-2025-102 and its amendment require employers with 10 or more employees to have an internal protocol against discrimination, violence, and workplace harassment, as well as a psychosocial risk management program, both of which must be duly registered with the Ministry of Labor. For their part, employers with fewer than 10 employees must comply with the guidelines issued by the Ministry of Labor.

The Ministry of Labor may verify compliance with this obligation at any time through random checks, inspections, or as part of a complaint investigation.

Compliance with this obligation does not end with the preparation and filing of these documents. The employer must carry out the specific actions outlined in them, such as training sessions, awareness campaigns, dissemination of the protocol, and follow-up activities. Accordingly, it is recommended to keep evidence of each activity carried out—such as attendance records, photographs, internal communications, or reports—in order to demonstrate compliance to the competent authority.
