NEW INTELLECTUAL PROPERTY RIGHTS FEES UNDER THE REGULATION OF COLLECTIVE MANAGEMENT SOCIETIES

Collective management societies administer, protect, and collect the economic rights of intellectual property on behalf of their affiliates. They act as intermediaries between rights holders and users of protected works, ensuring that users pay the corresponding fees for their use.

 

The National Intellectual Rights Service (SENADI) has issued key resolutions to regulate and oversee the fees set by these societies, aiming to balance the economic rights of the holders with accessibility for users.

 

Through resolutions 043-2024-DG-SENADI and 045-2024-DG-SENADI, SENADI approved the fees proposed by three collective management societies: SOPROFON, SARIME, and SAYCE.

 

Resolution 043-2024-DG-SENADI establishes the fees for SOPROFON, which safeguards the rights of phonogram producers, and SARIME, which manages the rights of performing artists. Meanwhile, resolution 045-2024-DG-SENADI approves the fees for SAYCE, a society responsible for administering copyright in the musical sector, covering activities such as reproduction, public communication, and synchronization of works.

 

Both resolutions are grounded in the principles of proportionality, equity, and reasonableness. In its approval process, SENADI conducted a technical analysis that incorporated inflation indices and comparative studies. Additionally, it engaged with collective management societies and relevant stakeholders to promote transparency and clarity regarding the fee structures.

 

These measures strengthen Ecuador´s music and cultural industries by establishing a regulated, sustainable, and equitable framework for the creation and use of protected works.
