Labor Alert: Is Your Internal Work Regulation Up to Date?

On August 22, 2025, the Ministry of Labor issued Ministerial Agreement MDT-2025-102, establishing the Internal Protocol for the Prevention and Eradication of Discrimination, Violence, and Workplace Harassment. This Protocol mandates that employers update their Internal Work Regulations to incorporate preventive measures against such conduct.

Similarly, current regulatory provisions regarding remote work, personal data protection, the use of social media, and improvements to the sanctions regime make it essential for Internal Work Regulations to reflect these changes.

Among the most important aspects to be considered in the update are the following:

1. Remote work and Digital Disconnection

  • Remote workmodalities.
  • Right to digital disconnection.

  • Control of time actually worked.

  • Prohibition of digital harassment and violence.

3. Personal Data Protection

  • Prohibition of misuse or commercialization.
  • Obligation to report security breaches.
  • Among others.

4. Prevention of Workplace Harassment (MDT-2025-102)

  • Definition of violence and harassment.
  • Internal reporting procedure.
  • Protection for whistleblowers and witnesses.
