On April 25, 2024, the General Directorate of the National Service of Intellectual Rights (SENADI) issued Resolution No. 006-2024-DG-SENADI, through which Resolution No. 002-2019-DG-NT-SENADI was partially amended. This resolution contains the codification of the fees and tariff regime regarding the values and discounts of the registration fees for contracts of groups A* and B** in the field of plant variety, as follows:
Official fees | Value of fees prior to the reform 002-2019-DG-NT-SENADI | Value of fees as from 25 April 2024 | ||
---|---|---|---|---|
Fee | Discount | Fee | Discount | |
Contract registration Group A | $ 579,40 | 90% | $ 72,00 | 50% |
Contract registration Group B | $ 579,40 | 90% | $ 72,00 | 50% |
*GROUP A: Ornamentals; fruit and ornamental trees, shrubs, and herbaceous plants; cucurbits; vines; vegetables; palms; and sugar cane.
**GROUP B: Other varieties not included in “GROUP A”, such as: cereals; tubers; roots; and Andean crops.
Access to fees discounts is extended to small and medium-sized farmers and peasant business organizations engaged in agricultural production, SMEs, independent researchers, higher education institutions, public sector entities, popular and solidarity economy enterprises, and artisans.
We are confident that this marks the beginning of administrative reforms aimed at reducing official fees, particularly for the registration and maintenance of breeder’s rights. We will continue to hold necessary meetings with SENADI and other authorities to achieve the required reductions in fees that hinder the development of the floriculture sector.
