{"id":4735,"date":"2026-06-08T15:06:51","date_gmt":"2026-06-08T20:06:51","guid":{"rendered":"https:\/\/tzvs.ec\/?p=4735"},"modified":"2026-06-08T15:09:23","modified_gmt":"2026-06-08T20:09:23","slug":"the-constitutional-court-recognizes-labor-protections-for-pregnant-workers-with-temporary-contracts","status":"publish","type":"post","link":"https:\/\/tzvs.ec\/en\/2026\/06\/08\/the-constitutional-court-recognizes-labor-protections-for-pregnant-workers-with-temporary-contracts\/","title":{"rendered":"The Constitutional Court recognizes labor protections for pregnant workers with temporary contracts"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On May 14, 2026, the Plenary Session of the Constitutional Court of Ecuador issued Ruling No. 36-22-CN\/26, establishing a binding constitutional interpretation regarding the termination of a special temporary contract when the employee is pregnant or breastfeeding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court ruled that automatically terminating a special temporary contract upon the expiration of its term, without considering the employee\u2019s pregnancy or breastfeeding status, violates Articles 43, 331, and 332 of the Constitution concerning job security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, the Court established that the employer must choose one of the following alternatives:<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Extension of the contract term:<\/strong> Extend the special temporary contract until the end of the breastfeeding period, without this implying that the contract becomes permanent.<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Change in contract type:<\/strong> Enter into another type of contract that ensures continuity and equal or better employment conditions (position and compensation) until the end of the breastfeeding period.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">If the employer terminates the contract at the end of its term without adopting either of these alternatives, the employee may file a claim for unlawful termination, allowing her to choose between reinstatement or severance compensation equivalent to one year\u2019s salary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This ruling applies to this specific case and similar cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For further information or labor law advice regarding the application of this ruling, please contact Tobar ZVS at <a href=\"mailto:laboral@tzvs.ec\">laboral @ tzvs.ec<\/a>.<\/p>\n\n\n\n<br><p style=\"text-align: center;color:gray;\">\u00a9 TobarZVS <\/p>\n<p style=\"text-align: center;color:gray;\">This publication contains information of general interest and does not constitute legal opinion on specific issues.
